These Terms, together with all relevant policies available on the Platform, outline your rights, obligations, and responsibilities; it is strongly advised that, prior to any use, users acquaint themselves with the scope and effect of these Terms to ensure compliance and informed engagement.

Whenever you use any Service offered by Brantford India through the Platform—including property reviews, partner feedback, and any additional features—you will be subject to specific rules, guidelines, policies, and conditions governing those Services, and such terms are considered an integral part of these Terms and Conditions. Continued use of any Service shall be deemed acceptance of all applicable provisions and policies as periodically updated. Brantford India reserves the right to amend, update, or modify these Terms at its sole discretion; such changes become effective immediately upon their publication on the Platform. Users are responsible for periodically reviewing the Terms to remain informed of any updates, and ongoing access or usage shall constitute conclusive acceptance of the revised conditions.

By accessing, browsing, or using our platform, website, mobile application, or any related services ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you disagree with any provision of these Terms, you must discontinue use of our Platform immediately.


1.4 Legal Capacity

Our services are available only to individuals, businesses, and entities that can form legally binding contracts under Indian law. You represent and warrant that:

i.  You are at least 18 years of age
ii. You possess the legal authority to enter into this agreement

  • "Content" means all text, graphics, images, music, software, audio, video, information, data, and other materials available on the Platform.
  • "Lead Generation" refers to our services for identifying and qualifying potential customers for real estate transactions.
  • "Listing" means property information, details, photographs, and related content posted on our Platform.
  • "Platform" collectively refers to our website, mobile applications, APIs, and all related technology services.

5. USER CONDUCT AND PROHIBITED ACTIVITIES

5.1 Acceptable Use

5.2 Prohibited Activities

You are expressly prohibited from:

i.     Unauthorized persons to access or use Brantford India’s Services or tools.
ii.    Resale, sublicensing, assignment, or any commercial exploitation of the Platform’s Services or property listings without explicit prior authorization is prohibited.
iii.    The Services must be used strictly for their intended and subscribed purposes, in compliance with Indian laws, regulations, and these Terms.
iv.    Posting, transmitting, or storing content that is defamatory, obscene, pornographic, exploitative, abusive, threatening, harassing, libellous, racially or ethnically objectionable, or otherwise unlawful or harmful is strictly forbidden.
v.    Content that threatens India’s sovereignty, security, unity, foreign relations, public order, or incites cognizable offences is prohibited.
vi.   Users must not impersonate any person or entity, falsify their affiliation, or disclose confidential or proprietary information without permission.
vii.  Uploading or transmitting viruses, malware, or any malicious code is forbidden; unauthorized attempts to access Brantford India’s systems, networks, or the Site are strictly prohibited.
viii. Use of bots, scrapers, crawlers, or similar automated tools without Brantford India’s prior consent is not allowed.
ix.   Users shall not unlawfully print, download, delete, amend, or misuse data posted by others or use third-party data without consent unless for lawful and permitted business purposes.
x.    Sharing false, misleading, or deceptive information, or content created to harm or misinform, is prohibited.
xi.   Sending unsolicited messages, spamming activities, or advertising unrelated services to other users is not allowed, including redirection of traffic from other platforms for promotional purposes.
xii.  Violations of these Terms may result in suspension, deactivation, or permanent blacklisting of User accounts.
xiii. We reserves the right to forfeit subscription fees and seek all appropriate legal remedies to recover losses resulting from breaches of these prohibitions.

5.3 Content Standards

All content submitted to the Platform must:
i.  Be accurate, truthful, and not misleading
ii  Comply with applicable advertising and consumer protection laws
iii. Respect privacy rights and data protection regulations
iv.  Not contain obscene, defamatory, or discriminatory material
v.   Include proper authorization for use of photographs and property information


6. CONTENT

6.1 Platform Content Ownership

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, images, software, and underlying technology, are owned by Brantford India or our licensors and are protected by Indian and international intellectual property laws.

6.2 User-Generated Content

By submitting content to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating and improving the Platform.

6.3 Content Responsibility

Users are solely responsible for the content they submit and must ensure:
• Legal ownership or proper authorization for all submitted materials
• Compliance with applicable laws and regulations
• Accuracy and completeness of property information
• Respect for third-party intellectual property rights

6.4 Content Removal

The Platform may contain links to external websites or services. We are not responsible for the content, privacy practices, or terms of service of external sites.


10. Intellectual Property Rights and Data Usage

All intellectual property rights in the Brantford India Platform, its Services, property listings, User data, and all associated content, including but not limited to text, images, designs, software, trademarks, logos, and brand elements, remain the sole and exclusive property of Brantford India or its licensors. Users acknowledge that they do not acquire any rights, title, or interest in the intellectual property except as expressly granted under these Terms.
Any content contributed by Users—such as property descriptions, images, reviews, or feedback—shall automatically vest in Brantford India upon submission. Unauthorized reproduction, distribution, or reuse of such content outside the Platform constitutes infringement, and Brantford India reserves the right to initiate appropriate legal action, including claims for damages and recovery of costs.
Trademarks, logos, and other brand features displayed on the Platform are either owned by or licensed to Brantford India. No rights or licenses are granted to Users for their use without prior written authorization. Unauthorized use of branding elements will be subject to legal remedies.
Users receive a limited, non-transferable, non-exclusive, and revocable license to access and use the Services strictly in accordance with these Terms and for their intended purposes.
Brantford India reserves the right to use and share User-provided data for operational, business analysis, marketing, and service improvement purposes, in compliance with applicable laws and our Privacy Policy. All data submitted by Users remains the exclusive property of Brantford India even following account suspension or termination, unless otherwise agreed in writing.
By submitting contact information such as mobile numbers or email addresses, Users consent to receiving communications—including calls, messages, alerts—from Brantford India, its affiliates, partners, and authorized agents regardless of any Do Not Disturb registration. Brantford India may also record and use calls made between Users and its representatives for quality, training, and compliance purposes.
Users who do not agree to these terms should refrain from submitting their personal or contact information on the Platform.


11. DISCLAIMERS AND LIMITATION OF LIABILITY

11.1 Service Disclaimers

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • ACCURACY OR COMPLETENESS OF CONTENT OR DATA

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANTFORD INDIA SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL
  • DAMAGES RESULTING FROM THIRD-PARTY CONDUCT OR CONTENT
  • AMOUNTS EXCEEDING THE FEES PAID BY THE USER IN THE 12 MONTHS PRECEDING THE CLAIM

11.3 Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or other force majeure events.


12. INDEMNIFICATION

12.1 User Indemnification

You agree to indemnify, defend, and hold harmless Brantford India, its affiliates, officers, directors, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Platform in violation of these Terms
  • Content you submit to the Platform
  • Your violation of any laws or third-party rights
  • Your breach of representations and warranties made herein

12.2 Scope of Indemnification

This indemnification obligation survives termination of these Terms and continues for all claims arising from your use of the Platform during the term of your agreement with us.

12. TERMINATION

12.1 Termination by User

You may terminate your account and cease using the Platform at any time by following the account closure procedures specified on the Platform. Termination does not relieve you of any outstanding payment obligations.

12.2 Termination by Company

We may suspend or terminate your access to the Platform immediately, without prior notice, if:

  • You breach any provision of these Terms
  • Your account shows suspicious or fraudulent activity
  • We are required to do so by law or regulation
  • Continued service provision becomes commercially impracticable

12.3 Effect of Termination

Upon termination:

  • Your access to the Platform will be immediately discontinued
  • All outstanding fees become immediately due and payable
  • We may delete your account data after a reasonable retention period
  • Provisions of these Terms that by their nature should survive will continue in effect

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. You agree that any dispute, claim or controversy arising out of or relating to your use of our platform, these Terms, or the services provided hereunder, shall first be attempted to be resolved amicably through good faith discussions within 30 (thirty) days of either party giving written notice of the dispute.

If such dispute is not settled through discussions, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The tribunal shall consist of a sole arbitrator appointed mutually by the parties. The seat and venue of arbitration shall be Pune, and the proceedings shall be conducted in English.

Subject to the foregoing, the courts of Pune, Maharashtra shall have exclusive jurisdiction in respect of all matters arising out of or connected with these Terms.

You also agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.


14. MODIFICATIONS TO TERMS

Brandford reserves the right, at its sole discretion, to add, modify, suspend, or discontinue any aspect of the Services, temporarily or permanently, at any time, with or without prior notice to the User.

For paid Services (if any), Brandford may, at its sole discretion, provide a pro rated refund for any unused portion in the event of permanent discontinuation.
    
Brandford may also, without assigning any reason and without notice, temporarily deactivate, restrict, or suspend access to the platform or any part thereof in order to carry out maintenance, upgrades, testing, repairs, or other technical activities necessary to ensure the proper delivery and functioning of the Services.

Brandford shall not be liable to the User or to any third party for any direct or indirect loss, damage, cost, or expense arising out of or in connection with any modification, suspension, or discontinuation of the Services, including during periods of maintenance. Except where expressly agreed by Brandford, no fees or charges already paid by the User shall be adjusted, refunded, or rebated in such cases.


15. AMENDMENTS

  1. The right to amend, vary, or modify the Term contained herein, as well as those in the Services Guide, shall rest exclusively with Brandford.
  2. The Agreement may be updated, and the Term may change periodically. Any such changes or updates will be posted on the Site. User are advised to visit the Site regularly to review the latest Term. For the avoidance of doubt, the User continued use of the Services shall constitute an acknowledgment and acceptance of the amended Term.

16. GENERAL PROVISIONS

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements you enter into with us, constitute the entire agreement between you and Brantford India regarding the Platform.

16.2 Severability

If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

16.5 Language

These Terms are originally drafted in English. Any translations are provided for convenience only, and the English version shall prevail in case of conflicts.
